TLC Gifting reserves the right to amend this Agreement at any time without prior notice. Your continued use of our services following any changes constitutes your acceptance of the revised Terms of Use. If you do not agree to these terms or any future modifications, please do not use or access (or continue to access) our services. This Agreement applies to all visitors, users, and others who access the services (“Users”).

1. Use of Our Services

A) Eligibility

You may use our services only if you can enter into a binding contract with TLC Gifting and only in compliance with this Agreement and all applicable laws, rules, and regulations. Access to our services is strictly prohibited for anyone under 18. Users previously removed from our services may not rejoin.

B) TLC Gifting Accounts and Ordering

Creating a TLC Gifting account allows you to order products available on our site and access features we may establish at our discretion. By connecting to TLC Gifting through a third-party service, such as social media, you authorize us to access your information from that service as permitted and to store your login credentials.

You may not use another User’s account without permission. When creating your account, you must provide accurate information and are solely responsible for all activity that occurs under your account. Please keep your password secure and notify us immediately of any unauthorized use of your account. TLC Gifting is not liable for any losses due to unauthorized account use.

You may manage your user profile and interaction settings in your account page. By providing your email address, you consent to receiving service-related notices, including legal notifications, via email. We may also send updates or special offers; you can opt out of these in your account settings.

C) Service Rules

To use our services, you agree not to engage in any of the following prohibited activities:

  1. Copying or distributing any part of the service in any medium.
  2. Using automated systems to access the service excessively.
  3. Transmitting spam, chain letters, or unsolicited emails.
  4. Attempting to interfere with or compromise system integrity or security.
  5. Imposing an unreasonable load on our infrastructure.
  6. Uploading harmful software or invalid data.
  7. Collecting personally identifiable information from the service.
  8. Using the service for commercial solicitation.
  9. Impersonating any person or misrepresenting your affiliation.
  10. Interfering with the proper working of the service.

We reserve the right to modify or terminate access to the service without notice. You remain bound by this Agreement even if your access is terminated.

You are responsible for your interactions with other TLC Gifting Users. We may monitor disputes but are not liable for any issues arising from User interactions.

2. User Content

Certain areas of our service allow Users to post content (e.g., comments, questions). You agree not to post content that:

  1. Risks harm to others or property.
  2. Exploits or harms minors.
  3. Constitutes illegal or harmful content.
  4. Infringes on third-party rights.

You affirm that you have the rights necessary to post such content and that it does not violate any laws or rights of others. TLC Gifting reserves the right to remove any content that violates these provisions.

3. Intellectual Property Rights

All content, except User Content, is the exclusive property of TLC Gifting and its licensors. You may not sell, license, or create derivative works from any TLC Gifting content without express permission.

4. No Professional Advice

All information provided is for informational purposes only and should not be considered professional advice. Seek independent professional guidance when necessary.

5. No Warranty

THE SERVICES, PRODUCTS, AND MATERIALS ARE PROVIDED ON AN "AS IS" BASIS. USE OF THE SERVICES IS AT YOUR OWN RISK. TLC GIFTING DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TLC GIFTING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF OUR SERVICES.

7. Governing Law

This Agreement is governed by the laws of the Republic of Ireland. Any disputes will be resolved exclusively in Irish courts.
